Zambelli Tassetto successfully represents IMG Candiani before the Tax Tribunal
The Tax Tribunal of the Province of Venice., further to Zambelli Tassetto’s appeal, vacated the decision of the Tax Authority in respect of an increase of the presumed charging basis for property tax on a multiplex cinema. The decision was rendered on the basis that the Tax Authority used an incorrect methodology in determining the presumed revenue that the property (a multiplex cinema built on land belonging to the Municipality of Venice but transferred to IMG Candiani – the developers – with a time limited interest in the building for the duration of sixty years) would generate. As a result of the decision, which is the first of its kind in respect of a building which is held separately from the ownership of the land, no local property tax increase will have to be paid in respect of the Multiplex.
